Welcome to FanSubs!

These are FanSubs' Terms of Use, and they apply to all users of the FanSubs platform. “We," “our," and “us" refer to Influencers.com “FanSubs" refers to this platform and the services offered by us, including the FanSubs iOS app, the FanSubs Android app, FanSubs APIs, FanSubs embeds, fansubs.xyz, and FanSubs' other websites. By using FanSubs, you agree to these terms and to the other policies we post, including the Privacy Policy, Community Guidelines, and Benefit Guidelines. Please read them carefully and let us know if you have any questions. For information about our data practices, please see our Privacy Policy and our Cookie Policy. We collect, use, and share information in accordance with those policies.

Your Account

When you create an account, you must provide us with accurate information, in good faith, and you agree to keep your information updated if it changes. To create an account or otherwise use FanSubs, you must be at least 13 years old and you must also be old enough to consent to the processing of your personal data in your country. You must be at least 18 years old or have your parent's or legal guardian's permission to have a creator page on FanSubs or to purchase an offering or subscription on FanSubs.

FanSubs strictly prohibits adult/18+ content, including but not limited to nudity, pornography, and sexually explicit material. Any violation of this policy will result in immediate account termination.

If a creator violates our terms, including but not limited to posting prohibited content, FanSubs reserves the right to withhold or forfeit any subscription earnings in their account at our sole discretion.

You are responsible for anything that occurs when anyone is signed in to your account, as well as the security of the account. Please contact us immediately if you believe your account is compromised. You can learn more about security in our Security Policy.

Abusive Conduct

You are responsible for all activity on your account. If you violate our terms or policies, then we may terminate your account. Don't do anything illegal, abusive towards others, that abuses FanSubs in a technical way, or that exploits FanSubs in an unintended manner that is detrimental to us, like using FanSubs as a storage platform. If you are a creator earning money on FanSubs, we may be exposed to risk based on what you do with those funds. As a result, we may also look at what you do outside of FanSubs. You can find more detailed information in the Community Guidelines and Security Policy. These terms and our policies cover most issues, but, if you find a new and creative way to hurt FanSubs or our community, we may take action to prevent it.

All About Being a Creator

Creator Page

To become a creator, simply launch your page to start your offering or membership. When you join FanSubs, you become part of the FanSubs community. You can use creator tools that we provide to, among other things, showcase your creations, engage with the FanSubs community, and provide merchandise to Fans through our merch service.

Memberships are for your most passionate Fans. On FanSubs, you can provide your Fans with exclusive benefits such as additional access, merchandise, exclusive creations, and engaging community experiences. In turn, you will receive support from your Fans and revenue from memberships and offerings that Fans have purchased on FanSubs.

Payments

As a creator, you may make offerings available on FanSubs on a one-time basis and may make memberships available on FanSubs on an automatically renewing subscription basis. We handle payment processing, including fraud prevention, chargebacks, and dispute resolution. Payments may be subject to delays due to factors such as security reviews or regulatory requirements.

FanSubs reserves the right to block or withhold payments for violations of our terms or policies, including failure to provide required tax documentation. Additionally, FanSubs may prevent transactions deemed fraudulent or unauthorized. If chargebacks, refunds, or other deductions put your balance into the negative, we reserve the right to recover those funds from future payments.

Fees

As a creator, there are fees associated with your offerings and paid memberships on FanSubs. These fees may include:

  • Platform fee: A percentage of successfully processed payments.
  • Payment processing fee: A percentage of successfully processed payments and a flat fee per transaction.
  • Payout fee: A fee for transferring money to your specified payout method.
  • Currency conversion fee: A percentage of payments processed in a currency different from your payout currency.

You can view applicable fees in your creator dashboard. Fees may vary based on the level of service you select and the payment platform used.

Taxes

To satisfy tax obligations, we collect tax identification information and, in certain circumstances, report this information and earnings to tax authorities as required. If you are a U.S. citizen and meet the federal earnings threshold, we will issue a Form 1099 for tax reporting purposes. If you are not a U.S. citizen, it is your responsibility to comply with your local tax laws regarding income reporting and tax obligations.

We also handle certain transactional taxes, including VAT, GST, and applicable state sales taxes, which may be added to payments made by Fans. FanSubs calculates, collects, and remits these taxes as required by law. You are responsible for ensuring the accuracy of your tax information and for any taxes owed on your earnings.

All About Being a Fan

As a Fan, you're supporting a creator and may receive special benefits like shoutouts, exclusive creations, or merchandise. You pay on a one-time or automatically-renewing subscription basis as specified; FanSubs is the billing entity that is associated with this charge. If your primary payment method fails and you've configured one or more backup payment methods, then we will charge those backup payment methods based on that configuration.

The timing and amount of each subscription or offering depends on the type of subscription or offering you select and the creator you support. You can see the details prior to purchasing the offering or starting the subscription and you can view all your active subscriptions and your billing history.

Subscription Types

FanSubs offers several types of subscriptions to give Fans flexibility in how they support their favorite creators. The available options may include:

  • Monthly subscriptions: You pay per month for continued access to the creator's content and benefits.
  • Per-creation subscriptions: You pay per piece of content published by the creator, with the ability to set a maximum limit per month.
  • Annual subscriptions: You pay for a full year of access up front, typically at a discounted rate.

Each of these subscriptions renew automatically unless canceled.

Managing Your Subscription

You can manage or cancel your subscription at any time through your account settings. Changes to your subscription, including cancellations, may impact your access to creator content and benefits:

  • Monthly and annual subscriptions: Canceling or lowering your support tier will affect your next billing cycle.
  • Per-creation subscriptions: Lowering your support tier affects the next charge, and canceling prevents future per-creation charges.
  • Annual subscriptions: These can be canceled but not downgraded mid-term. Upgrading to a higher tier may apply credit from previous payments.

Canceling or lowering your support tier may result in losing access to creator content, benefits, and community features.

Refunds and Failed Payments

FanSubs does not generally offer refunds, but exceptions may be granted at our sole discretion. If your payment method fails, FanSubs will attempt to collect the payment from backup methods if available. If a payment cannot be processed, your access to subscription benefits may be revoked.

If you believe there has been an unauthorized charge on your account, please contact our support team immediately. Refunds and chargebacks may result in the loss of access to content and potential account restrictions.

Taxes

Depending on your location, FanSubs may be required to collect and remit taxes, such as VAT or sales tax, on your subscription payments. These taxes will be included in your total charge where applicable. You are responsible for ensuring your billing information is accurate to facilitate correct tax collection.

Additional Subscription Conditions

Your ability to access a creator's content may change if:

  • The creator removes content or alters access levels.
  • Your payment fails or is refunded.
  • FanSubs terminates your account or removes the creator from the platform.
  • The creator stops using FanSubs or deletes their account.

FanSubs does not guarantee uninterrupted access to any content or benefits and reserves the right to make adjustments to subscription offerings in accordance with our terms and policies.

FanSubs' Role

We actively monitor content on FanSubs to ensure compliance with these Terms of Use and our Privacy Policy. This includes reviewing creator pages, posts, and interactions between users. If we identify content that violates our terms or receive reports from users about potential violations, we may take action, which could include issuing warnings, removing content, suspending accounts, or terminating accounts entirely.

Investigations into potential violations can take time to complete, and FanSubs reserves the right to review activity both on and off the platform in cases where we believe there is a risk to our community, our business, or our compliance obligations. This may include analyzing how creators use their earnings, reviewing reports of fraudulent activity, or investigating actions taken outside of FanSubs that could impact the integrity of the platform.

We do not guarantee the removal of any particular content, nor do we guarantee that all reported violations will result in action. Decisions regarding content moderation and enforcement are made at FanSubs' sole discretion, and we may update our policies as necessary to adapt to new challenges and risks. If you believe a violation has occurred, we encourage you to report it through the appropriate channels.

Account Deletion

You can permanently delete your account at any time by going to your account settings.

We can terminate or suspend your account at any time at our sole discretion. We can also cancel any memberships and remove any descriptions, posts, offerings, or benefits at our sole discretion. You may not bring a claim against us for suspending or terminating another person's account, and you agree you will not bring such a claim. If you try to bring such a claim, you are responsible for the damages caused, including attorneys' fees and costs. These terms remain in effect even if you no longer have an account.

Your Creations

Creators keep full ownership of their creations and Fans keep full ownership of what they post on FanSubs, but we need licenses from you for this material in order to operate FanSubs' services effectively. By making creations available on FanSubs or otherwise posting on FanSubs, you grant us a royalty-free, perpetual, irrevocable, non-exclusive, sublicensable, worldwide license covering your creation or what you post in all formats and channels now known or later developed anywhere in the world to use, copy, reproduce, store, translate, transmit, distribute, perform, prepare derivative works, publicly display, and display in connection with any name, username, voice, or likeness provided in connection with it.

Fans do not have the same rights as FanSubs regarding content. Fans are granted a limited, non-exclusive, non-transferable, non-sublicensable license to access and view content from creators they support for personal, non-commercial use only. Fans may not reproduce, distribute, publicly display, modify, create derivative works from, or otherwise exploit any content from FanSubs without explicit permission from the creator or FanSubs. Unauthorized use of creator content may result in termination of your account and potential legal consequences.

Indemnity

You will indemnify us from all losses and liabilities, including legal fees, that arise from these terms or relate to your use of FanSubs. We reserve the right to exclusive control over the defense of a claim covered by this clause. If we use this right, then you will help us in our defense. Your obligation to indemnify under this clause also applies to our subsidiaries, affiliates, officers, directors, employees, agents, and third-party service providers.

Warranty Disclaimer

FanSubs is provided “as is" and without warranty of any kind. Any warranty of merchantability, fitness for a particular purpose, non-infringement, and any other warranty, whether express or implied, is excluded and disclaimed to the greatest extent permitted by law. The disclaimers of warranty under this clause also apply to our subsidiaries, affiliates, and third-party service providers.

Everything Else

These terms and any referenced policies are the entire agreement between you and us, supersede all prior agreements, and don't create any partnership, joint venture, employee-employer or franchiser-franchisee relationship between you and us. If any provision of these terms is held to be unenforceable, then that provision is modified to the extent necessary to enforce it.
